About the app and these Terms
These Terms govern the Stenheim App, a free iOS and Android companion app provided by STENHEIM Suisse SA ("Stenheim", "we" or "us"). The app lets you discover, set up, configure, personalise and control compatible Stenheim products. Please read these Terms before use. Do not use the app if you do not accept them.
The app is free of charge; Stenheim hardware is purchased separately. These Terms do not replace or reduce any separate sales terms, warranties or statutory rights relating to your hardware purchase. Our separate Privacy Policy explains how information is handled when you use the app.
Your right to use the app and intellectual property
We grant you a limited, non-exclusive licence to install and use the app on devices you own or control, for personal use with compatible Stenheim products, subject to these Terms and applicable app-store usage rules.
The app is licensed, not sold. Intellectual property in the app belongs to Stenheim and/or its licensors. Third-party content belongs to its respective rights holders. Any rights granted under applicable third-party software licences remain unaffected.
Permitted use
Do not use the app unlawfully, interfere with its operation or security, or use it to access or control products or networks without authorisation.
Do not copy, distribute, sell, modify, reverse engineer, decompile or attempt to obtain the source code of the app, except as permitted by these Terms, applicable app-store rules, relevant software licences or rights that cannot legally be excluded.
Compatibility
The app requires a compatible Stenheim product, mobile device and operating system. Available functions may depend on the product, software version and supported services.
We make reasonable efforts to maintain reliable operation and compatibility with supported products and services. We cannot guarantee compatibility with every device, operating-system version or third-party service, or that every third-party service will remain supported.
Third-party applications, services and content
The app and Stenheim products may open or interact with third-party applications and services, including music streaming services, or display their content. Your relationship with those providers is governed by their own terms and privacy policies.
Subject to section “Warranties and liability“ and mandatory applicable law, Stenheim is not responsible for personal data independently collected or processed by those providers, or for their audio streams, track, artist or album information, artwork or other content, including its accuracy, availability or legality. The same applies to the quality, availability or performance of their services, interruptions affecting them, and changes made by their providers.
Networks, external dependencies and availability
Some functions depend on your local network, Wi-Fi configuration, internet connection, mobile operating system, third-party applications, streaming providers, or third-party interfaces and protocols. Changes made by Apple, Google or other platform and service providers may affect those functions.
Although we make reasonable efforts to maintain compatibility, we cannot guarantee uninterrupted availability or compatibility where functions depend on external systems or third-party services. The app or some functions may also be temporarily unavailable during maintenance, updates or resolution of technical problems.
Updates and changes to functionality
We may release updates to maintain security, address issues, improve operation or respond to legal or technical requirements. Updates may be needed for continued compatibility.
Features may change or be withdrawn when third-party services or technical requirements change. We will give reasonable advance notice of material reductions in functionality where practicable and comply with applicable obligations concerning updates, notice, consent and consumer remedies.
Warranties and liability
We aim to provide a reliable app, but do not promise that it will always be uninterrupted, error-free or suitable for every particular purpose. To the extent permitted by law, the app is provided "as available", without additional warranties beyond those expressly given or required by law.
To the extent permitted by law, we are not liable for losses that could not reasonably have been foreseen, or for failures caused solely by external systems beyond our reasonable control.
Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, or any other liability that cannot legally be excluded or limited. Your mandatory consumer rights, including any applicable rights concerning conformity, updates and remedies, remain unaffected.
Ending use and discontinuation
You may stop using and uninstall the app at any time. We may terminate your licence for a serious breach of these Terms, giving a reasonable opportunity to remedy it where appropriate.
We may discontinue the app or a feature for legal, security or technical reasons, or where continued provision is no longer reasonably feasible. We will give reasonable advance notice where practicable. This does not remove any continuing obligations or remedies under mandatory law or any separate hardware warranty or sales terms.
Changes to these Terms
We may revise these Terms to reflect changes to the app, external services or applicable requirements. We will publish the revised text with an updated date, provide reasonable advance notice of material changes, and obtain your agreement where required by law. Changes will not apply retroactively.
Governing law
These Terms are governed by Swiss law, except where mandatory law requires otherwise. This choice does not deprive consumers of mandatory protections applicable in their country of residence. Nothing in these Terms restricts any right to bring proceedings before a court available to you under mandatory applicable law.
